I forget which really old Greek dude said it, but accordingly there is a finite amount of work, and everything after that is derivative. So, whoever you're told is what your work is derived from, is derived work, from an earlier work itself, and again, and again. What you want to avoid is when your work is a "copy" of another work. e.g. Star Wars (4 (-6?)) is virtually a copy of an earlier Chinese movie from the 1950's, even going so far as to use one character's name "Han." The setting was changed, and a lot of high tech was used, but the rest nearly identical. e.g. George Harrison, unknowingly copied an earlier work for his song "My dear lord." He even went as far as admitting that he unknowingly copied it. He knew the earlier work (He's so fine) and admitted he liked it (thereby was familiar with it).
